Groceritta is operated by AREM TRADE.
1. Scope & Acceptance of Terms
1. These Terms govern the use of the Groceritta marketplace, including browsing, account creation, placing orders, and purchasing Products from independent Sellers.
2. By using the platform, the Customer accepts these Terms.
3. The Terms apply to Consumers and Entrepreneurs. For Consumers, additional rights apply under Polish law.
4. AREM TRADE provides the platform, payment handling, and customer support.
5. A separate Sales Agreement is created between the Customer and each Seller included in the Order.
2. Definitions
Customer / User – any person placing an Order.
Seller / Store – independent merchant offering Products via Groceritta.
Operator / Platform – AREM TRADE.
Product(s) – goods listed for sale.
Order – Customer’s offer to purchase Products.
Sales Agreement – separate contract with each Seller.
3. Model marketplace
1. Groceritta operates as a multi-vendor marketplace.
2. Each Product indicates its Seller, who is legally responsible for it.
3. AREM TRADE is not a party to Sales Agreements for Products offered by third-party Sellers.
4. One checkout may include Products from multiple Sellers, creating separate contracts.
5. Delivery and fees are calculated individually per Seller.
4. Seller Responsibility & Platform Liability Limitation
1. Sellers are fully responsible for:
product quality and condition
safety, ingredients, labeling, allergens
correct and legal product descriptions
expiration dates
packaging
pricing entered by the Seller
warranty (rękojmia) obligations
compliance with food safety regulations
2. Groceritta (AREM TRADE) is NOT liable for:
defective or unsafe products
incorrect or misleading product descriptions
expired or damaged items delivered by Sellers
missing allergen or ingredient information
pricing errors caused by Sellers
order fulfillment delays caused by the Seller or courier
product content, origin, manufacturer claims
3. The Operator may support communication but legal responsibility remains with the Seller.
4. Groceritta may warn, limit, suspend, or remove Sellers who violate marketplace rules or legal obligations.

5. Products Sold Directly by AREM TRADE
1. Some Products may be sold directly by AREM TRADE (“Groceritta Products”).
2. These Products are clearly marked as such.
3. AREM TRADE is the Seller for these items and responsible under consumer law.
4. Groceritta may set its own pricing strategy for its Products.
6. Product Availability Disclaimer
1. Product availability depends on Sellers’ stock and may not update in real time.
2. If a Product becomes unavailable, the Seller or Operator may cancel that Product and refund the Customer without liability.
3. No compensation or additional claims may be pursued for unavailable items.
7. Price Errors (Technical Faults)
1. In case of an obvious price error (e.g., 100 PLN listed as 1 PLN due to technical glitch), the Seller or Operator may:
cancel the affected Product, or
correct the price and request Customer confirmation.
2. Price-error orders are not legally binding.
8. Technical Requirements
Customer must use a modern browser and ensure cookies are enabled.
9. Account Registration
1. Optional; guest checkout is possible.
2. Customer must provide accurate and current information.
3. Customer is responsible for account security.
10. Ordering Process
1. Customer selects Products and proceeds to checkout.
2. Multi-store orders are allowed; each store represents a separate contract.
3. Order confirmation email constitutes acceptance of the Offer by each Seller.
4. Orders containing food cannot be modified after payment.
11. Minimum Order Value per Seller
1. Each Seller has a minimum order requirement of 100 PLN.
2. Orders below 100 PLN per Seller cannot be completed.
3. System informs the Customer when the minimum is not met.
12. Delivery Fees, Free Delivery Thresholds & Multi-Store Logistics
12.1 Per-Store Delivery Calculation
A separate delivery fee is calculated for each Seller.
12.2 Standard Delivery Fee
19.90 PLN per Seller.
12.3 Free Delivery Threshold
Free delivery applies per Seller for orders ≥ 250 PLN from that Seller.
12.4 Example
Store A – 100 PLN → 19.90 PLN delivery
Store B – 50 PLN → 19.90 PLN delivery
Store C – 251 PLN → free delivery
12.5 Separate Deliveries
Deliveries from multiple Sellers may arrive:
separately
at different times
using different couriers
Customer accepts this by placing an order.
13. Delivery Failure Due to Customer
1. If delivery fails due to reasons attributable to the Customer (wrong address, no answer, inaccessible location):
delivery fee is not refundable
order may not be re-delivered
perishable items cannot be returned or refunded
2. Standard in food delivery services.
14. Customer Responsibility for Correct Information
Customer must provide:
correct address
correct phone number
correct email
Operator is not liable for failed delivery due to Customer errors.
15. Product Handling After Delivery
1. Customer is responsible for proper storage according to labeling.
2. Operator and Sellers are not liable for deterioration caused by:
failure to refrigerate
exposure to heat
delays in unpacking
3. Critical for food safety.
16. Right of Withdrawal (Consumers)
1. Consumers may withdraw within 14 days unless exceptions apply.
2. Perishable food, opened hygiene products, or temperature-sensitive goods are NOT returnable.
3. Refund is issued within 14 days once Seller receives the withdrawn item.
4. Return shipping costs apply unless Seller states otherwise.
17. Complaints & Warranty (Rękojmia)
1. Product complaints must be directed to the Seller.
2. Groceritta may assist communication but is not responsible for Seller obligations.
3. Warranty rules follow Polish Civil Code.
4. Platform-related complaints go to AREM TRADE.
18. Fraud, Abuse & Misuse of Services
Groceritta may suspend or terminate Customer accounts for:
fraudulent orders
return abuse
abusive behavior towards staff
attempting to manipulate pricing
creating multiple accounts to exploit promotions
violations of law or Terms
19. Personal Data & Privacy
Data is processed under GDPR and Polish data protection law.

20. Electronic Services Act Compliance
Platform complies with Polish Act on Electronic Services (UŚUDE):
cookies
electronic communication
prohibited content rules
21. Intellectual Property
All platform content is protected by copyright.
22. Modifications to Terms
Groceritta may update Terms; changes apply from publication unless law requires otherwise.
23. Governing Law & Dispute Resolution
1. Polish law applies.
2. Consumers may use ODR or in-country ADR.
3. Polish courts have jurisdiction unless EU consumer rules state otherwise.
